Legal information and acceptance

The present provisions govern the use of the service of the Internet Portal (hereinafter, Portal) that Seresco, S.A., (hereinafter, SERESCO) makes available to Internet users.

Pursuant to Art. 10 of Act 34/2002 of 11 July, regarding Services of the Information Society and Electronic Commerce, we inform you that the Web Page accessible from the domain is property of SERESCO, S.A., with registered office at Calle Matemático Pedrayes, 23, in Oviedo, Spain, Postal Code 33005, and Tax ID Code no. SERESCO informs you that it is the owner or holder of the corresponding license or transfer of use for the various contents, including the trademarks, texts, photographs, audiovisuals, drawings, designs, software, source code and information incorporated for this purpose that are displayed throughout the Web Portal.

Access to the web page is free of charge except for the cost of the connection via the telecommunications network provided by the access provider contracted by the users. The use of the Portal attributes the status of Portal User (hereinafter, User) and implies the acceptance of all conditions, without any exception, that are included in this Legal Notice, as well as others that could be derived from the regulations in force and that are not mentioned expressly in the present notice. The provision of the service of the Portal is limited in time period to the time that the User is connected to the Portal or to any of the services provided through it. Therefore, the User must read the present Legal Notice carefully every time that he intends to use the Portal, since it could undergo modifications.

Some of the Portal’s services are accessible for any Internet Users or exclusively for the clients and/or employees of SERESCO, since they may be subject to specific conditions, regulations and instructions, which, when relevant, substitute for, complement and/or modify the present Legal Notice and which must be accepted by the User before the provision of the corresponding service begins.

It is also necessary for the User to review our privacy policy and cookies policy to have more complete information about the Portal, since these may feature further specifications regarding this legal notice and the company’s general privacy policy.

Conditions for use of the portal

The conditions that govern the different services available on the web are subject to, among others, the following regulations to the extent applicable: Act 34/2002, of July 11, concerning the Services of the Information Society and Electronic Commerce; Regulation EU 2016/679 of April 27 concerning the protection of natural persons regarding the processing of personal data and the free movement of these data, which repeals Directive 95/46/EC (General Data Protection Regulation); Royal Decree-Act 1/2007 of November 16, which approves the Revised Text of the General Act for Defense of Consumers and Users and other complementary Acts; such as the intellectual property regulations or the trademark rights regulations.

The use of and access to the contents hosted on the web imply the awareness of all clauses included in the present text of Legal Notice, the privacy policy and cookies policy, which have as their purpose to inform users of their rights, uses, prohibitions, responsibilities when browsing the web.

Use of the Web Page and Services

Browsing and use of the Portal, as well as the services included on the Portal, are completely free of charge. Moreover, the user commits to use the Portal correctly in accordance with the content of the present Legal Notice, the regulations in force both nationally and in the European Union, and subject to the principles of good faith and due diligence. Any illegal use is explicitly prohibited, as is any use contrary to public order and/or damaging to the rights and interests of individuals.

SERESCO reserves the right to take any actions before arbitrators or courts that it sees fit in the event that the Users make improper or illegal use of the web page. The User will answer to SERESCO or to third parties for any damages that could be caused as a result of failure to comply with these obligations.

Exclusion of liability

Access to the Portal does not imply the obligation on SERESCO’s part to verify the truthfulness, precision, adequacy, suitability, exhaustiveness and up-to-date status of the information provided through the Portal. The contents of this page are of a general nature, for the purpose of giving information on the different activities and services that SERESCO offers. SERESCO does not accept liability for decisions made based on the information provided in the Portal nor for the damages produced for the User or third parties caused by actions, the only base for which is the information obtained in the Portal.

Access to the Portal does not imply the obligation on SERESCO’s part to monitor the absence of any harmful computer element that could damage the User’s assets. It is the duty of the User, in all cases, to have tools available that are adequate for detecting and disinfecting damaging computer programs or malware that could affect them while browsing on the Portal.

SERESCO does not accept liability for damages produced in computer equipment nor for damages to the Users’ or third parties’ intellectual or industrial property rights while providing the service of the Portal.

Access to the Portal requires third-party services and supplies, including transportation through the telecommunications networks, and SERESCO is not liable for the reliability, quality, continuity and functioning of these. Since third parties manage some of the support services, the services available from the Portal may be suspended, canceled or become unavailable during access or browsing on the Portal.

Intellectual and industrial property

All contents of the Portal, including but not limited to trademarks, texts, photographs, graphs, graphic images, icons, technology, software, links and other audiovisual contents or sound contents, as well as their graphic design and source codes, are subject to intellectual property regulations, and SERESCO holds the rights to these, whether in its own right, or by license or transfer granted by third-party owners which may be on a complete or partial, permanent or temporary, basis.

The use of the services provided through the Portal does not attribute to the Users, nor does it grant them, the ownership of the contents or any rights to exploitation recognized in the intellectual property regulations, which include, among others, copying, distribution or transformation of these contents, with the exception of those contents that are necessary for the functioning of the services provided by the Portal.

The trademarks, trade names or distinctive marks are property of SERESCO or of third parties who cede them for its use, and access to the Portal cannot be interpreted to bestow any right to these. Their use is prohibited except with express authorization of SERESCO, S.A., or the third-party owner.

In accordance with regulations in force, the User must refrain from copying, distributing, making available, communicating publicly, transforming or modifying the contents, images, documents or texts of the web page, except in cases authorized by law or expressly consented to by SERESCO or by whoever holds ownership of the exploitation rights, when relevant.

The users of the Portal are prohibited from all such actions, including but not limited to:

  • Exploiting the contents of the Portal commercially, including in this prohibition the products derived after their modification, copying or reuse.
  • Reproducing, copying, extracting, transforming or reusing for private use or commercial exploitation any contents considered as graphic design, source code, software or database.

The reproduction of the contents of SERESCO’s Portal on third-party web pages is prohibited; only a link can be shared that connects the Portal’s homepage, and only if SERESCO’s has previous knowledge of this. The owner of the web page that links contents improperly and in breach of this legal notice will be liable for the damages that could be caused for SERESCO or for third parties.

Term and modifications

The present Legal Notice will be in force for as long as it is displayed.

The present Legal Notice and Privacy Policy may be modified by SERESCO at any time in their entirety or in part, and Users must review the content regularly to verify the information. Modifications take effect from the time that they are published on the Portal.

Nullity and inefficacy

In the event that any provision of the present conditions is considered null or inapplicable, in its entirety or in part, due to the applicability of a modification in regulations or due to court ruling or arbitrators’ decision, the rest of the notice will continue to be valid.

SERESCO’s choice not to exercise rights or take actions against third parties due to failure to comply with the provision or prohibitions included in the present legal notice will not constitute a waiver of these rights or actions, unless this is acknowledged or agreed in writing by SERESCO.

Applicable law and jurisdiction

Any dispute, conflict or situation derived from the present conditions will be submitted to the Courts and Tribunals of Oviedo, and the parties hereby expressly waive any other venue to which they may be entitled.
